WASHINGTON - Former Pentagon analyst Larry A. Franklin was sentenced Friday to a 12 years and seven months imprisonment for passing classified information to former American Israel Public Affairs Committee lobbyists.
Franklin was also found guilty of sharing classified information with Israeli diplomat Naor Gilon. He was also fined $10,000.
In sentencing Franklin, U.S. District Judge T.S. Ellis III said the facts of the case led him to believe that Franklin was motivated primarily by a desire to help the United States, not harm it.
Franklin, 59, had worked with top Pentagon officials, including former undersecretary of defense for policy Douglas Feith, and is an expert on Iraq and Iran.
Franklin pleaded guilty in October in a plea bargain, and will testify in the trial of former AIPAC lobbyists Steve Rosen and Keith Weissman slated to start in April 2005. Franklin's sentence could be then further reduced because of his cooperation with the government.
Rosen and Weissman, who are facing charges of disclosing confidential information to Israel, were fired from AIPAC in 2004.
The judge said that Franklin believed the National Security Council was insufficiently concerned with the threat posed by an unspecified Middle Eastern nation. Franklin thought leaking information might eventually persuade the Security Council to take more serious action, he said.
While the Middle Eastern country was not named in the court record, sources and the facts of the case point to Iran.
Ellis said he viewed Franklin's case differently than a case involving information leaked to the Soviets at height of the Cold War.
"But not different to the extent of excuse. Not at all," Ellis said.
Franklin at one time worked for Feith, then the Pentagon's No. 3 official, on issues involving the Middle East. During a court appearance last year, Franklin said he would occasionally be questioned directly by Defense Secretary Donald Rumsfeld and former top Pentagon official Paul Wolfowitz on policy issues.
As a result, Franklin said, he sometimes took classified information home to stay up to speed. One of the charges to which he pleaded guilty was unlawful retention of classified national defense information.
Franklin admitted that he met periodically with Rosen and Weissman between 2002 and 2004 and discussed classified information, including information about potential attacks on U.S. troops in Iraq.
Rosen and Weissman would subsequently share what they learned with reporters and Israeli officials.
Rosen was a top lobbyist for Washington-based AIPAC for more than 20 years, and Weissman was the organization's top Iran expert. AIPAC fired them in April and says it has cooperated with the investigation.
Prosecution attorneys said Friday in U.S. District Court for the Eastern District of Virginia they would consider releasing the court from federal sentencing guidelines once Franklin completes his cooperation in the case against Rosen and Weissman.
Franklin asked that he be allowed to serve his sentence at a minimum security prison near his home.

Pentagon Analyst Gets 12 Years for Disclosing Data

WASHINGTON, Jan. 20 - A federal judge sentenced a former Defense Department analyst, Lawrence A. Franklin, to more than 12 years in prison today after Mr. Franklin admitted passing classified military information to two pro-Israel lobbyists and an Israeli diplomat.
The sentence meted out to Mr. Franklin, 59, by Judge T. S. Ellis III in Federal District Court in Alexandria, Va., was at the low end of the federal sentencing guidelines. Judge Ellis said at the hearing that he believed Mr. Franklin was motivated by a desire to help the United States, not to damage it.
Mr. Franklin's sentence, which included a fine of $10,000, was the first victory for the government in a case in which prosecutors have also indicted the two lobbyists with whom he shared classified information. The charges against Mr. Franklin and the two lobbyists are offenses under the Espionage Act, but none of the men have been accused of spying.
The lobbyists, Steven J. Rosen and Keith Weissman, were senior staff members of the American Israel Public Affairs Committee, or Aipac, a pro-Israel lobbying organization with close relationships to officials in the Bush administration.
The case is unusual because of the charges against the lobbyists, who did not hold security clearances, were not government employees or representatives of a foreign government. They operated in a small circle of lobbyists who have commonly traded gossip and inside information with administration officials, Congressional aides and journalists.
Before his sentencing, Mr. Franklin pleaded guilty to three felony counts for improperly retaining and disclosing classified information in exchange for his cooperation and the government's willingness to drop three other charges against him. He will not have to begin serving his sentence until after the completion of legal proceedings against Mr. Rosen and Mr. Weissman, who are scheduled to go on trial in April. That could lead prosecutors to agree to seek a reduction in Mr. Franklin's sentence, government official said.
Mr. Rosen and Mr. Weissman were charged in an indictment in August 2005 with conspiring to gather and disclose classified national security information to journalists and an unnamed foreign power that government officials identified as Israel. Aipac dismissed the two men in April 2005.
The indictment said the two men had disclosed classified information about a number of subjects, including American policy in Iran, terrorism in central Asia, Al Qaeda and the 1996 bombing of the Khobar Towers apartment in Saudi Arabia, which killed 23 Americans, mainly members of the military. Lawyers for the two men have sought to have the indictment against them dismissed.
As Aipac's director of foreign policy issues, Mr. Rosen was a well-known figure in Washington who helped the organization define its lobbying agenda on the Middle East and forged important relationships with powerful conservatives in the Bush administration. Mr. Weissman was a senior Middle East analyst. Mr. Rosen and Mr. Weissman have denied any wrongdoing.
Mr. Franklin, who was regarded as an Iran expert, was among Bush administration conservatives who had pushed for an aggressive policy towards Iran, including a more confrontational approach to restrain its nuclear program.
Mr. Franklin worked at the Pentagon for a time under Douglas Feith, a former undersecretary at the agency. Mr. Franklin has said he developed a relationship with the two lobbyists in the belief that they had access to officials a the National Security Council and could communicate his views to senior officials there.
In addition to his meetings with the lobbyists, the government charged, Mr. Franklin also met with an Israeli embassy official and passed on secret military information about weapons tests in the Middle East and military activities in Iraq. He contended that the information was already known to the Israelis and that he obtained far more information than he gave away.

ADL chief: Franklin affair could pose threat to Jewish lobbyists

Two days after former Pentagon analyst Larry A. Franklin was sentenced to 12 years and seven months in jail for sharing classified information with pro-Israel lobbyists, several American Jewish community leaders echoed a single refrain: There's reason to worry, but no need to feel like this is a crisis.
Anti-Defamation League director Abe Foxman said the Franklin affair could potentially pose a threat to all Jewish lobbyists.
Foxman said it is not clear what exactly is allowed in terms of the relationships between the administration and the media and between nongovernmental organizations and foreign governments. The lack of clarity, he said, could have a destructive influence on the activities of all U.S. Jewish groups.

Rosen and Weissman, he said, "are two patriotic American citizens working for a Jewish organization, who did nothing to violate the American security."

A former Defense Department analyst was sentenced to more than 12 years in prison yesterday for passing government secrets to two employees of a pro-Israel lobbying group and to an Israeli government official in Washington.
U.S. District Judge T.S. Ellis III said Lawrence A. Franklin did not intend to harm the United States when he gave the classified data to the employees of the American Israel Public Affairs Committee, or AIPAC, one of Washington's most influential lobbying organizations. When he pleaded guilty, Franklin, an Iran specialist, said he was frustrated with the direction of U.S. policy and thought he could influence it through "back channels."
"I believe, I accept, your explanation that you didn't want to hurt the United States, that you are a loyal American," said Ellis, who added that Franklin was "concerned about certain threats to the United States" and thought he had to hand information about the threats to others to bring it to the attention of the National Security Council.
But Franklin still must be punished, Ellis said, because he violated important laws governing the non-disclosure of secret information.
"It doesn't matter that you think you were really helping," Ellis said as he sentenced Franklin to 151 months -- 12 1/2 years -- in prison. "That arrogates to yourself the decision whether to adhere to a statute passed by Congress, and we can't have that in this country."
The sentence fell at the low end of the federal sentencing guidelines, which called for a term as long as 188 months. "It could have been tougher,"' said Michael Greenberger, a former Justice Department official who heads the Center for Health and Homeland Security at the University of Maryland.
The sentencing in U.S. District Court in Alexandria closed one chapter of a long-running investigation into an alleged conspiracy to obtain and illegally pass classified information to foreign officials and reporters. But with the case still shrouded in secrecy, yesterday's hearing cast no new light on the information Franklin provided, whether its transmission harmed the United States and whether anyone will be charged other than the two lobbyists, who have been fired by AIPAC and are awaiting trial.
Assistant U.S. Attorney Kevin V. Di Gregory told Ellis that Franklin had reason to believe that the information could be used against the United States. "When you disclose national defense information to people not entitled to receive it," he said, "the U.S. government loses control of that information and there is no way to know in whose hands it might fall."
Plato Cacheris, Franklin's attorney, emphasized that Franklin is "a longtime dedicated public servant" who has had "a long and distinguished career." Cacheris said that Franklin has been cooperating extensively with investigators and that he expects the government to file a motion later to reduce Franklin's sentence.
Franklin pleaded guilty in October to three counts: conspiracy to communicate national defense information, conspiracy to communicate classified information to an agent of a foreign government, and unlawful retention of national defense information.
Court documents said Franklin provided classified data -- including information about a Middle Eastern country's activities in Iraq and weapons tests conducted by a foreign country -- to the lobbyists and to an unnamed "foreign official."
The Middle Eastern country was not named, but Franklin disclosed at his plea hearing that some of the material related to Iran. He also said in court that the foreign official was Naor Gilon, who was the political officer at the Israeli Embassy before being recalled last summer. Israeli officials have said they are cooperating in the investigation, and they denied any wrongdoing.
Franklin is expected to testify against the two former AIPAC lobbyists, Steven J. Rosen and Keith Weissman, at their trial, which is scheduled for April.
Rosen, of Silver Spring, is charged with two counts related to unlawful disclosure of national defense information obtained from Franklin and other unidentified government officials on topics including Iran, Saudi Arabia and al Qaeda. Rosen was AIPAC's director of foreign policy issues and was instrumental in making the committee a formidable political force.
Weissman, of Bethesda, faces one count of conspiracy to illegally communicate national defense information.
The FBI monitored a series of meetings between Franklin and the former AIPAC officials dating back to early 2003, multiple sources familiar with the investigation have said. At one of those meetings, a session at the Pentagon City mall in Arlington in July 2004, Franklin warned Weissman that Iranian agents were planning attacks against U.S. soldiers and Israeli agents in Iraq, sources said.

Franklin's fate
Larry Franklin has been sentenced to twelve years for his role in the AIPAC spy scandal. Since the Zionists have assured us that there is no AIPAC spy scandal, and it is just anti-Semitism, you have to wonder what the twelve years are for. The kicker is that he doesn't have to report to jail, but gets some time in the great outdoors to consider whether he'd like a lower sentence in return for cooperating in nailing AIPAC. If he goes to court and tells Americans what AIPAC has been up to, that will be the end of the 'special relationship' between Israel and the United States. It goes without saying that he can't be allowed to go to court. So what will it be, 'accident' or 'suicide'?
