| Mistake of fact was a trumped up excuse fitted to an old Egyptian horse carrier that had not been seen for weeks possibly months. Yet when Israel needed an alibi there she was as if the heavens had just opened and placed her gently in position in the far Eastern Mediterranean. Bullshit!
Israel intended the attack knowing full well exactly what they were doing. The spy ship Liberty had to be neutralized. Ilana the farmer makes heavy weather of the armaments on the aircraft being unsuitable for sinking a ship. I say they only needed to incapacitate her. | | This has been a sweet victory for justice. Israel has been convicted on all three counts: Murder, Malicious wounding, and unlawful destruction of property. There seems no prospect of an appeal by the defense. They have not got the balls for it. The file is not closed however. There remains the issue of malicious intent. Israel intended her actions while fully aware that the Liberty was an American ship and her motive was to incapacitate her as a spy ship. But this will have to wait until Israel can find a brief capable of leading her defense. The defense team that has just been so soundly beaten is not capable of rising from the ashes. JD, DD and FF for the prosecution are, I believe, ready to fight again for the final victory of proof of malicious intent. But we may have to wait a while for the relevant testimony to emerge.
