| Democracy Distorted By Dr. E.A. Richards In a true democracy there are laws passed by a legislative body,signed by a legal executive, conceived in the idea that all citizens of that democracy be treated in the same manner, regardless of race,creed, color, or ethnic origin. However, in the State of Israel,self-described as the only "democracy" in the Middle East, democratic principles with regard to certain citizens have been flouted in dastardly manner. Here are the basic facts: In two separate cases, the Israeli government, supported by the Israeli judges, forcibly deported two innocent Palestinians from the West Bank and into Jordan. The Israeli Supreme Court did not intervene. It justified the State's actions, and saw nothing wrong or evil in this act. They stated that it's "legally" permissible to take all Palestinians who also hold Jordanian citizenship and evict them from the West Bank into Jordan. This means that hundreds of thousands of Palestinians are now in danger of being forcibly evacuated from their homes and their properties forfeited.A petition filed by a courageous attorney in Israel, to the lower court - the Jerusalem District Court - was denied. In a shameful decision, which can only be called a terrible miscarriage of justice,Judge Moshe Gal authorized this deportation. An appeal to the to the Israeli Supreme Court was denied on June 26 2002, and the "Honorable Justices" saw nothing wrong in this, and gave the State the greenlight.The two innocent Palestinians that the Israeli government have planned to deport in a few days: Case No. 1 Maher Diuk Mr. Maher Diuk has lived in the past few years in the West Bank city of Ramallah. He is married to Aida Diuk, who is 8- months pregnant. He also holds Jordanian citizenship. He was caught trying to look for a job in Israel. He is not accused of committing any crime or any act of violence. Israeli authorities detained him without trial for more than 90 days in the Maasiyahu Detention Center. The Israeli authorities decided to deport him to Jordan, cutting him away from his pregnant wife. Once he was notified of their intention,his attorney filed a petition to the Jerusalem District Court, showing the court documents from the Palestinian Authority proving that since he is married to a Palestinian and been living there for a few years,he is considered a Palestinian and the PA has given him their citizenship. The Jerusalem District Court simply disregarded these documents, and held that Israel can deport this innocent man into Jordan. The fact that he's been living in the West Bank for years, that he has family there - did not bother them at all. The court acted like a rubber-stamp for the Israeli authorities.His attorney appealed to the Israeli Supreme Court, but it seems they are no exception to the perverted morality that exists in Israel. In a 3-sentence verdict, they rendered a decision allowing the State to carry out this deportation. Case No. 2 Magdi Nagar Mr. Magdi Nagar is a Palestinian citizen living in the West Bank city of Beit Sahur (near Bethlehem). He has lived there for seven years. He also holds Jordanian citizenship. He is betrothed to a Palestinian girl. He was caught trying to look for a job in Israel. Israeli police detained him, and the Israeli authorities announced they are going to deport him to Jordan.He is not accused of committing any crime or any act of violence. He has also been detained in the Maasiyahu Detention Center for more than 80 days. Upon hearing that he is about to be deported into Jordan, he filed - through his attorney - a petition to the Jerusalem District Court, submitting the documents that prove his Palestinian citizenship.It was the same judge - Judge Moshe Gal - who rendered the decision,and, not surprisingly, denied the petition. The Judge claimed that the documents were not submitted in a "timely" fashion, therefore he is allowed to disregard them.The attorney appealed to the Supreme Court of Israel but to no avail.In another 3-sentence verdict, the court rendered a decision rejecting the appeal, and allowed the State to carry out this deportation. It seems the Israeli judges are allowing the State to perform a small-scale ethnic cleansing in a flagrant violation of basic human rights. This action should serve as a warning to all Palestinians that hold Jordanian citizehships.There is no palpable cause for deporting these two Palestinians, other than the Israeli government wishes to confiscate their lands and goods when they are gone. So what can we and the world do about this travesty? One of the more effective approaches is one of grassroots actions.meaning that those who consider these iniquitous, undemocratic, acts should contact the officials in these two cases, either by letter,email, fax, or telephone, and go on record to them decrying the unfairness of judges who claim to be part of a democratic government. But, in this case, the judges acted as conspirators in a perverte dregime, and should be held responsible for the State's illegal andimmoral policy of deportation for confiscation. The judges should be reprimanded and informed that the enlightened citizens of the world are ashamed of them, and that they should reverse the policy that has taken away their self respect in the name of greed.
